TERMS OF SERVICE

1. LEGAL DISCLOSURE (DISTANCE SALES CONTRACT)

Under the British Columbia Business Practices and Consumer Protection Act, this document serves as your Distance Sales Contract. By placing an order on www.hikesilver.shop, you acknowledge that you have been provided with, and have had the opportunity to review, the following "Required Information" before the contract was entered into.

3. PRODUCTS & PRINT-ON-DEMAND (POD) SPECIFICATIONS

As a specialized outdoor and hiking brand, our products are Future Performance Contracts because they are manufactured after the order is placed.

  • Detailed Description: HikeSilver provides custom-printed apparel and accessories. Technical specifications (material, weight, sizing) are listed on each product page.

  • Nature of POD: You acknowledge that because items are made-to-order, minor variations in print placement and color (within a 10% threshold of the digital mockup) are standard and do not constitute a "misdescription" under BC Law.

4. PRICING & HIDDEN COSTS

  • Itemized Price: The price shown at checkout is the final price for the goods.

  • Currency: All transactions are processed in CAD (unless the currency switcher is used, in which case the final currency will be clearly displayed).

  • Taxes: BC customers are subject to 7% PST and 5% GST. Other Canadian customers are subject to their respective provincial HST/GST.

  • US/International Charges: If you are ordering from the US, we cannot reasonably determine customs duties or brokerage fees in advance. The customer is responsible for all import fees.

5. DELIVERY & THE "30-DAY RULE"

  • Supply Date: We aim to ship all orders within [e.g., 7–10] business days.

  • BC Statutory Right: Under BC law, if your order is not delivered within 30 days of the "Expected Delivery Date" (or 30 days from the order date if no date is given), you have the right to cancel the contract and receive a full refund within 15 days of your request.

  • Carrier: We primarily use [e.g., Canada Post/UPS/DHL]. The risk of loss passes to you upon our delivery to the carrier.

6. REFUNDS & CANCELLATIONS (BC COMPLIANCE)

  • No "Change of Mind": In BC, there is no automatic legal right to return goods because you changed your mind. Because our goods are custom-produced (POD), all sales are final once production begins.

  • Legal Warranty: Notwithstanding the above, under the BC Sale of Goods Act, all products are protected by a legal warranty that they are: (1) Fit for the purpose intended; (2) Of merchantable quality; and (3) Durable for a reasonable period.

  • Defects: If an item fails these conditions (e.g., arrived torn or with the wrong print), you must notify us within 14 days for a replacement or refund.

7. OUTDOOR USE & LIABILITY LIMITATION

HikeSilver apparel is intended for recreational use only.

  • No Technical Warranty: Our products are not "safety equipment" or "survival gear."

  • Assumption of Risk: By using HikeSilver products during hiking or outdoor activities, you assume all risks inherent to the activity. To the maximum extent permitted by BC law, HikeSilver’s total liability for any claim shall not exceed the purchase price of the specific product.

8. INTELLECTUAL PROPERTY

All designs, including the "HikeSilver" logo and minimalist hiking artwork, are protected under the Canadian Copyright Act. Unauthorized reproduction of our designs for commercial use is strictly prohibited and will be prosecuted under Canadian law.

9. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of British Columbia. Any dispute that cannot be resolved through our support team shall be submitted to the Civil Resolution Tribunal (CRT) for claims under $5,000, or the Provincial Court of BC for larger claims. You agree that the venue for any legal proceeding shall be Vancouver, BC.

10. ELECTRONIC COPY

You will receive a copy of this contract via email immediately after your purchase. Please retain this for your records, as it contains your cancellation rights.
